OS DESAFIOS DA REGULAÇÃO
Resumo
A OECD define regulação económica como a imposição de regras pelos governos, apoiada pelo uso de sanções que visam, especificamente, modificar o comportamento económico de indivíduos e empresas. As importantes falhas ident ificadas nos mercados de seguros de saúde e de prestação de cuidados de saúde fazem com que este seja um dos campos clássicos da intervenção regulatória. Com efeito, as at ividades de regulação da saúde estão presentes na generalidade dos sistemas de saúde contemporâneos, embora sob formas nem sempre explícitas e devidamente estruturadas e autonomizadas. Porém, o grau de disseminação da regulação da saúde não encont ra proporcionalidade no grau de consenso político, social ou académico em torno de muitos dos seus aspetos cent rais. As discussões principais cent ram-se, atualmente, não na necessidade da existência de regulação da saúde, mas em aspetos part iculares como o grau de independência face ao governo e aos agentes dos mercados, os custos diretos e indiretos da at ividade de regulação ou a escolha entre regulação do sistema e autorregulação por profissionais de saúde. Em Portugal, a regulação independente da saúde surgiu em 2003 e, não obstante as dificuldades iniciais de aceitação por parte dos stakeholders, esta forma de intervenção pública nas at ividades de saúde assume, hoje, um papel fulcral no sistema de saúde português.
